A conflict of interest arises when our interests, or those of our team or partners, could differ from yours, or when the interests of two clients could differ from each other. We cannot always avoid conflicts, but we will always tell you about them and manage them fairly. This summary explains how.
How we are paid. Fortis Arbor may receive commission or fees from the providers of the products we introduce, from companies we introduce to investors, and from real estate developers and agents we introduce buyers to. This can create an incentive to recommend one option over another.
Acting across our two divisions. Fortis Arbor Wealth acts for private clients and families; Fortis Arbor Capital acts for companies raising capital. A Wealth client could be introduced to an opportunity that Fortis Arbor Capital is paid to raise money for.
Our partners. We work with lenders, product providers, real estate partners and other firms involved in a transaction, some of whom may pay us.
Personal interests. Members of our team may hold personal investments, receive gifts or hospitality, or have relationships with companies we work with.
Disclosure of payments. Before you act, we tell you in writing who pays us, how much or on what basis, and in what form. We do not hide that we may be paid by the companies we introduce.
Suitability first. Recommendations to Wealth clients are based on their needs and circumstances, not on the remuneration we receive. Where we are paid by the issuer of an opportunity, we say so before any introduction and we never present it as independent advice.
Separation of information. Confidential information about Capital clients is shared on a need-to-know basis only and is not used for the benefit of Wealth clients, or the other way round.
Gifts and personal dealing. Our team must declare gifts and hospitality above a modest value and any personal interest in a company we work with, and these are recorded in a register.
Declining to act. If a conflict cannot be managed fairly, we will decline to act or stop acting.
We keep a record of conflicts identified and how each was handled, and we review this policy at least once a year. A copy of the full policy is available on request from info@fortisarborwealth.com.
We want to hear when we have fallen short. This procedure explains how to raise a complaint, what we will do with it and where you can go if you are not satisfied with our answer.
You can complain by email to info@fortisarborwealth.com (please put “Complaint” in the subject line), by telephone on +971 4 594 3801, or in writing to Fortis Arbor L.L.C-FZ, Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates. Please tell us your name and contact details, what went wrong, when it happened and what you would like us to do to put it right. Making a complaint is free of charge.
We will acknowledge your complaint in writing within five working days and tell you who is handling it. Complaints are investigated by a senior member of the team who was not involved in the matter complained about. We aim to send you a full written response within 30 days. If we need longer, we will write to explain why and tell you when to expect our answer. Our final response will set out what we found, whether we uphold your complaint and any remedy we are offering.
Fortis Arbor is not regulated by a financial services regulator, so there is no financial ombudsman with jurisdiction over Fortis Arbor itself. Depending on what your complaint concerns, you may still have further rights:
Products provided by third parties. Where your complaint relates to a policy, plan or investment issued by a third-party provider, you may complain to that provider directly and, if you remain dissatisfied, to the regulator or ombudsman in the provider’s jurisdiction. We will tell you who that is and help you do so.
UAE insurance and banking products. If your complaint concerns a product provided by a UAE-licensed insurer or bank, you may refer it to Sanadak, the UAE’s financial services ombudsman (sanadak.gov.ae), once you have first complained to that institution and either received its response or waited 15 days without one.
Capital raising and debt introductions. Where another firm is involved in your transaction, we will tell you who it is and how to complain to it, and help you do so.
Nothing in this procedure affects your right to take legal action.
We keep a record of every complaint, our investigation and our response for at least six years, and we review complaints regularly to learn from them.
